BREAKING: Abba Kyari Acquitted of Asset Declaration Charges

A Federal High Court in Abuja has discharged and acquitted suspended Deputy Commissioner of Police (DCP) Abba Kyari and his two brothers, Mohammed and Ali, of a 23-count charge of alleged non-declaration of assets filed by the National Drug Law Enforcement Agency (NDLEA). The court ruled that the prosecution failed to provide sufficient evidence to prove the allegations, describing the case as "watery" and lacking credible proof [1][2][3].

Justice James Omotosho held that the NDLEA did not present documents linking Kyari to disputed properties, including those in Fountain Estate, Kasana, and Linda Choko Road, Asokoro. The judge also noted that ownership of land can be proven through traditional history, title documents, acts of possession, or possession connected to an owner, none of which were presented by the prosecution [1][5].

Kyari had maintained that the properties in Borno State belonged to his late father and were inherited by him and his siblings, a claim the court found was not disproven by the prosecution. The acquittal pertains specifically to asset declaration charges, and separate drug trafficking proceedings may continue independently [3][9].
